I-DEP's Cancellation Policy

I-DEP Deposition Services cancelled within two (2) business days of when they are scheduled to occur are subject to a $200 cancellation fee; those cancelled within one (1) business day of when they are scheduled to occur are subject to a $300 cancellation fee. Some or all of this fee may be waived if shipping of I-DEP equipment or if site testing was not required.

Improper Notice Policy:

As a standard, I-DEP adheres to the Federal Rules of Civil Procedure, specifically, Rules 30(b)(4) and 30(b)(7). Please be advised that by default I-DEP saves a copy of the audio/video file to the computer's hard drive. You will need to let I-DEP know if you would like the audio/video file to be destroyed to avoid potential subpoena. Please be advised that if I-DEP's services, whether in whole or in part, are cancelled on the day of the scheduled deposition due to improper notice, YOU WILL BE CHARGED ALL APPLICABLE FEES AND RATES FOR THE ENTIRE DAY, as listed above.

Legal Notice - I-DEP Post-Production Services Agreement:

By submitting videotaped or other recorded material ("Content") to I-DEP, LLC ("I-DEP"), you are requesting the specific processing service(s) indicated in your Confirmation Notice. You therefore agree to pay the standard charges for these services, including the standard fees for all individuals you have authorized to receive copies of the Content upon condition of their non-payment of these same standard fees. You also agree that the liability of I-DEP and its agents and employees, for any losses or damages of any kind or nature to your Content is limited to the cost of replacing the recording medium (e.g., VHS videotape, digital video tape, CD-ROM disk, etc) with a new, blank replacement of that same recording medium. You also agree that I-DEP and its agents and employees, shall not be otherwise liable for any loss or damage of any kind or nature, whether direct, incidental, consequential, or otherwise. You also stipulate that you (a) have the right to permit I-DEP to perform the services on the recording medium and Content you have submitted, as contemplated by your agreement to the Confirmation Notice, including copying and converting processes, (b) the Content does not injure, infringe, or violate any patent, copyright, trade secret, trademark or other intellectual property right of any third party, or violate any obscenity law or other applicable law, rule or regulation in any jurisdiction in which the Content may be viewed or retrieved, (c) I-DEP's provision of the processing and/or hosting of the Content hereunder will not infringe upon or violate any patent, copyright, trade secret, trademark or other intellectual property right of any third party, including but not limited to any and all performance license rights, mechanical license rights, synchronization license rights and rights under the Digital Performance Right in Sound Recordings Act of 1995, or violate any obscenity law or other applicable law, rule or regulation in any jurisdiction in which the Content may be viewed or retrieved, and (d) the Content and I-DEP's provision of the processing service on your behalf is not for any illegal, obscene, offensive or immoral purpose.
